Minutes of the Pre-Bid Meeting - Annual Maintenance Contract (AMC) and Facility Management Service (FMS) of Computer Hardware, Software and Peripherals at Reserve Bank of India, Bhubaneswar

Corrigendum

e-Tender No: RBI/Bhubaneswar Regional Office/Others/1/23-24/ET/439.

Pre-bid meeting for the captioned e-tender was held on February 12, 2024, 15:00 Hrs in the FIDD Conference Room, 3rd floor, Main Office Premises, RBI, Bhubaneswar, to discuss some clauses of the tender and to clarify queries, if any, raised by the interested vendors/ bidders. The meeting was attended by the following persons:

2. Discussions were held among the representatives of the Bank and Vendors, clarifications arrived thereof are tabulated below:

1 Section I: 16.21 Release of payment on monthly basis The Bank shall release quarterly payments towards the maintenance charges after the expiry of each quarter on receiving the quarterly bills not later than fifteen days of the succeeding month.
2 Section II: 9 Is OEM certification  mandatory? It is clarified that the company should preferably have OEM (Original Equipment Manufacturer) certification or Authorization or Service provider certificate.
3 Section I: 16.17 Data recovery in case of SSD/HDD crash The vendor shall be responsible for recovery of data, free of cost, in case of SSD/HDD crash of any computer systems under AMC.
4 Annexure-XII Amount for which solvency certificate shall be obtained. Adequate and satisfactory evidence to indicate financial capacity of the Organization to undertake the said work with names of Bankers and their full address. (Solvency certificate from the Bank as given in Annex VI) and Income Tax Return for the last three years shall be attached).
5 Section I: 15.n. Working Hours of Engineers deployed. The normal working hours on weekdays will be from 9.00 AM to 7.00 PM and from 9.00 AM to 06.00 PM. on Saturdays. At least one engineer has to report at 9.00 AM on all days and at least one engineer should remain in office till 7.00 PM from Monday to Friday and up to 6.00 PM on Saturdays. The resident engineers shall report to the DIT on all working days during office hours. However, Bank may require the services of the REs before or beyond working hours and on non-working days at no extra cost to the Bank.
6 Section I: 16.21 and 16.22 Minimum wages

a. The Vendor should submit the bill along with necessary documents showing compliance with instructions pertaining issued under Minimum Wages Act, 1948, Employees’ Provident Fund, ESIC, Gratuity and Miscellaneous Provisions Act,1952, Employees State Insurance Act, 1948, Payment of Gratuity Act,1972 etc., and any other relevant statutory provisions whichever is applicable.

b. The Bank reserves the right to verify compliance in this regard and Vendor should be able to produce evidence, at any point in time, of having paid required minimum wages and all other requisite statutory payments in respect of REs deployed at the Bank.

7 NIT-f. Estimated Cost of Tender It is informed that Estimated Cost of Tender is indicated in the NIT and vendor is free to quote their own price.
8 Section I: 13. Maintenance-Replacement of Defective parts The vendor shall replace any worn out or defective parts/components of all the IT assets under Comprehensive AMC, at the Bank’s cost. In case of replacement of any of the defective parts or whole of the system, the vendor may be required to replace the parts with the new parts of the same brand/model at own cost and submit a separate bill for reimbursement of parts replaced to the Bank along with the quarterly bill. The vendor shall not charge any fee or service charge in that bill as the same shall be covered under AMC contract. Accordingly, the Bank shall pay the cost of replacement parts to the vendor after detailed scrutiny of the bill and the parts replaced.
9 - Exemption of EMD to select MSMEs Companies/vendors qualifying for exemption of EMD will be examined on case-to-case basis on the production of valid documentary evidence such as certification etc.
10 - Important Instructions Regarding E-tender Process in MSTC portal. Bidders were advised to carefully undertake the bidding on the MSTC and ensure that they are registered on the MSTC Portal/ Website and are also allowed by the Bank to participate in the bid for the captioned tender. Bidders were asked to coordinate with MSTC Support Persons if they face any issue while undertaking the bidding for the captioned e-Tender.
11 Section I:15. Q. Other Terms and Conditions The vendor should use online call logging Management system to track the calls and fasten the process. All the resident engineers will coordinate with facility management through Online Call Logging & Management System.
12 Section I : 11. i. Performance Security The successful tenderer shall furnish along with the contract the Performance Bank Guarantee (PBG) for 10% of contract value in accordance with Annexure XI within one month from the award of work order. The PBG shall be valid for a period of 60 days after the expiry of contract period. The EMD of such tenderer will be returned on receipt of the PBG and after verification of the same with the concerned bank
13 - Pre-Qualification criteria It was reiterated that non-submission of the Pre-Qualification documents may result in rejection of the participation of the bidder.
14 Section I : 16.15 Penalties

a. Penalty of 5% of Quarterly bill amount (base amount i.e., excluding taxes) will be levied if monthly and / or quarterly preventive maintenance schedule is not done.

b. If any of the IT asset is not repaired or the problem is not rectified within two working days of registration of complaint, a penalty of Rs.150/- per day for PCs & peripherals, Rs.500/- per day for Laptops/ Notebooks shall be imposed on the Company and the same shall be deducted from the dues of AMC & FMS subject to a cap per complaint of Rs.1500/- for PCs and peripherals; Rs.2000/- for Laptops/Notebooks. Further, the Bank reserves the right to get such defective IT asset repaired from third party Company and the amount spent for such repair would be deducted from AMC & FMS charges.

c. A penalty of ₹1,000/- per day per engineer shall be levied for the absence of any of Resident Engineer.
